These Terms and Conditions apply to the use of the Exclusive Coatings online store and to products purchased from Exclusive Coatings Pty Ltd.
By placing an order through our website, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions, subject always to any rights that may apply under South African law.
1. General Information
All products sold by Exclusive Coatings via its online store are intended for automotive refinishing and related purposes.
While every reasonable effort is made to ensure the accuracy of product descriptions, images, technical specifications, pricing, compatibility information, and other website content, Exclusive Coatings does not guarantee that all information will at all times be entirely error-free, complete, or current.
Where an obvious pricing, product, stock, or information error is identified, Exclusive Coatings reserves the right to correct the error and, where necessary, contact the customer before processing the order.
2. Colour Matching Disclaimer
Automotive paint is mixed according to manufacturer-approved formulations based on the vehicle paint code, colour information, or other details supplied by the customer.
The customer acknowledges that a perfect colour match cannot be guaranteed when relying solely on a paint code.
Colour variations may occur due to paint fading, ageing and weathering, previous repairs or resprays, different factory colour variants, manufacturing tolerances, application technique, spray equipment and settings, primer or substrate colour, environmental conditions, and clear coat and finishing procedures.
For best results, customers are strongly advised, where practical, to provide a physical sample such as a fuel flap, petrol cap, or similar removable vehicle part for final colour matching.
Where no physical sample is provided, the paint will be prepared based on the information supplied by the customer and the applicable manufacturer's colour formulation.
A colour formula is not a guarantee of an exact visual match to the vehicle.
Customers should conduct a spray-out or test-panel application before applying paint to the full vehicle or valuable surface.
3. Customer-Supplied Information
The customer is responsible for ensuring that all information supplied when placing an order is correct.
This includes, where applicable, vehicle make and model, paint code, colour code, colour variant, product selection, pack size, quantities, delivery information, and any special mixing or preparation instructions.
If incorrect information is supplied by the customer and the product is prepared accordingly, Exclusive Coatings will not be responsible for the resulting mismatch or incorrect product specification, except where applicable law provides otherwise.
4. Application and Product Use
The final appearance and performance of automotive paint and related products depend on correct preparation, mixing, application, and curing.
Factors affecting results may include surface preparation, primer and undercoat colour, product compatibility, mixing ratios, application technique, spray gun settings, air pressure, temperature, humidity, dust or contamination, flash-off periods, drying and curing procedures, and clear coat selection and application.
Customers are responsible for selecting products suitable for their intended application and for using them in accordance with the relevant manufacturer's technical data sheets, instructions, safety requirements, and mixing ratios.
Exclusive Coatings will not be responsible for unsatisfactory results caused by incorrect application, incompatible products, misuse, contamination, or other external factors beyond its reasonable control, subject always to applicable law.
5. Custom-Mixed and Specially Prepared Products
Mixed paints, tinted products, colour-matched products, and other goods prepared specifically according to a customer's instructions may be treated as custom-made or specially prepared goods.
These products are generally non-returnable and non-refundable for change-of-mind reasons where permitted by law.
This does not remove any statutory rights a customer may have where a product is defective, unsafe, not of acceptable quality, incorrectly supplied, or otherwise does not comply with applicable South African consumer protection legislation.
Custom-mixed or colour-matched products will not qualify for a refund solely because the customer is dissatisfied with the colour where the paint was correctly prepared according to the information supplied and applicable formulation.
6. Product Quality and Manufacturer or Supplier Issues
Exclusive Coatings sources products and raw materials from manufacturers and suppliers.
Where a product is subject to a manufacturer's or supplier's warranty, that warranty may apply in addition to the customer's rights against Exclusive Coatings.
Nothing in these Terms and Conditions is intended to remove or limit any obligation that Exclusive Coatings may have as retailer under applicable South African law.
If a customer suspects that a product is defective, contaminated, incorrectly manufactured, or otherwise unsuitable due to a product defect, the customer should contact Exclusive Coatings before disposing of or further using the product where reasonably possible.
Exclusive Coatings may require the product to be inspected or tested and may request relevant photographs, batch numbers, labels, application information, or other reasonable supporting information.
7. Orders and Acceptance
An order placed through the website constitutes an offer by the customer to purchase the selected products.
Exclusive Coatings reserves the right, where legally permitted, to refuse or cancel an order where a product is unavailable, an obvious pricing or product error has occurred, payment has not been successfully completed, fraud or misuse is reasonably suspected, required customer information is incomplete or incorrect, or Exclusive Coatings cannot reasonably fulfil the order.
Where payment has already been received for an order that cannot be fulfilled, an appropriate refund will be processed.
8. Pricing and Payment
Prices displayed on the website will be stated in South African Rand unless otherwise indicated.
Applicable VAT will be charged in accordance with South African tax requirements.
Payments made through the online store may be processed by third-party payment providers such as Payfast or other approved payment services.
Exclusive Coatings does not store or directly process the customer's full payment card information where payment is processed through an external payment provider.
The terms, security procedures, and processing times of the relevant payment provider may also apply to the transaction.
9. Shipping and Delivery
Orders are delivered through Bob Go, appointed courier companies, or another delivery service selected by Exclusive Coatings.
Delivery times are estimates and may vary due to destination, courier operations, traffic, weather, public holidays, operational delays, or other circumstances beyond our reasonable control.
Customers are responsible for providing a correct and complete delivery address and for ensuring that someone is available to receive the order where required.
Exclusive Coatings will make every reasonable effort to ensure that orders are correctly packaged and handed over for delivery in good condition.
Any delivery delay, loss, or damage claim will be handled in accordance with the Exclusive Coatings Shipping Policy and applicable law.
Risk in the goods passes to the customer upon delivery, subject to applicable South African law.
10. Returns and Refunds
Returns and refunds are governed by the Exclusive Coatings Paint Return & Refund Policy.
Customers should review that policy before placing an order, particularly where custom-mixed, tinted, colour-matched, or specially prepared products are being purchased.
Nothing in the Paint Return & Refund Policy or these Terms and Conditions is intended to remove or restrict any statutory consumer rights that cannot legally be excluded.
11. Product Images and Website Content
Product images displayed on the website are intended to assist customers in identifying products.
Packaging, labels, colours, branding, container designs, or other visual elements may change from time to time without materially changing the product itself.
Customers should rely on the product name, product description, size, variant, and other specified product information rather than product imagery alone.
12. Product Availability
Products displayed on the website may be subject to stock availability.
Exclusive Coatings reserves the right to discontinue products, change available pack sizes, or update its online product range where necessary.
Where an ordered product is unexpectedly unavailable, the customer will be contacted and offered an appropriate remedy, which may include cancellation and refund of the unavailable item.
13. Limitation of Liability
To the fullest extent permitted by South African law, Exclusive Coatings will not be liable for indirect, incidental, special, or consequential losses arising from improper product selection, misuse, incorrect application, or circumstances beyond its reasonable control.
This may include loss of income, loss of profit, vehicle downtime, labour costs, panel-beating costs, respraying costs, removal or reapplication costs, and other consequential losses.
Nothing in these Terms and Conditions excludes or limits liability where such liability cannot lawfully be excluded or limited.
14. Website Use
Customers may use the Exclusive Coatings website for lawful shopping, product research, account management, and related purposes.
Customers may not use the website to commit fraud, attempt unauthorised access, interfere with website security, introduce malicious software, misuse website content, or engage in unlawful activity.
Exclusive Coatings reserves the right to restrict access where misuse is reasonably suspected.
